Indexed Annuities and Certain Other Insurance Contracts ]]></title>

  <description><![CDATA[ We are proposing a new rule that would define the terms 
``annuity contract'' and ``optional annuity contract'' under the 
Securities Act of 1933. The proposed rule is intended to clarify the 
status under the federal securities laws of indexed annuities, under 
which payments to the purchaser are dependent on the performance of a 
securities index. The proposed rule would apply on a prospective basis 
to contracts issued on or after the effective date of the rule. We are 
also proposing to exempt insurance companies from filing reports under 
the Securities Exchange Act of 1934 with respect to indexed annuities 
and other securities that are registered under the Securities Act, 
provided that the securities are regulated under state insurance law, 
the issuing insurance company and its financial condition are subject 
to supervision and examination by a state insurance regulator, and the 
securities are not publicly traded.

National Emission Standards for Hazardous Air Pollutants: Area  Source Standards for Plating and Polishing Operations]]></title>

  <description><![CDATA[ We are issuing national emission standards for control of 
hazardous air pollutants (HAP) for the plating and polishing area 
source category. This final rule establishes emission standards in the 
form of management practices for new and existing tanks, thermal 
spraying equipment, and mechanical polishing equipment in certain 
plating and polishing processes. These final emission standards reflect 
EPA's determination regarding the generally achievable control 
technology (GACT) and/or management practices for the area source 
category.

  <description><![CDATA[ The Office of Foreign Assets Control (``OFAC'') of the 
Department of the Treasury is amending Appendix A to 31 CFR chapter V 
to (1) reflect the addition or removal from Appendix A, since it was 
last published, of the names of individuals and entities subject to the 
various economic sanctions programs administered by OFAC, and (2) 
provide updated identifying and clarifying information for certain 
individuals and entities included in the appendix. OFAC also is 
amending the notes to the appendices to 31 CFR chapter V to reflect the 
revisions to Appendix A and changes in the status of several programs.

and employment regulations of the Department of Veterans Affairs (VA) 
concerning VA's responsibility to provide notification regarding 
information or evidence needed for an individual to substantiate a 
claim for vocational rehabilitation benefits and services, and 
regarding applicable time periods. VA's duty to assist claimants in 
substantiating their claims for benefits is expanded by The Veterans  Claims Assistance Act of 2000, and is<br/> [[Page 37403]]<br/>
incorporated in this rulemaking. Specifically, upon receipt of a 
substantially complete application for benefits, VA will make 
reasonable efforts to help the claimant obtain the evidence necessary 
to substantiate the claim. In addition, VA proposes to make changes to  improve readability and other clarifying changes that are <br/>
nonsubstantive.

                By the authority vested in me as President by the 
                Constitution and the laws of the United States of 
                America, including section 301 of title 3, United 
                States Code, and consistent with section 6(j)(4)(B) of 
                the Export Administration Act of 1979, Public Law 96-
                72, as amended (50 U.S.C. App. 2405(j)), and as 
                continued in effect by Executive Order 13222 of August 
                17, 2001, 66 FR 44025, I hereby certify, with respect 
                to the rescission of the determination of January 20,                  1988, regarding North Korea that:<br/>

(i) the Government of North Korea has not provided any support for 
international terrorism during the preceding 6-month period; and

(ii) the Government of North Korea has provided assurances that it will not  support acts of international terrorism in the future.<br/>

                This certification shall also satisfy the provisions of 
                section 620A(c)(2) of the Foreign Assistance Act of 
                1961, Public Law 87-195, as amended (22 U.S.C. 
                2371(c)), and section 40(f)(1)(B) of the Arms Export

  <title><![CDATA[
Bankruptcy Filing Date Treated as Plan Termination Date for  Certain Purposes; Guaranteed Benefits; Allocation of Plan]]></title>

  <description><![CDATA[ This is a proposed rule to implement section 404 of the 
Pension Protection Act of 2006. Section 404 amended Title IV of ERISA 
to provide that when an underfunded, PBGCcovered, singleemployer 
pension plan terminates while its contributing sponsor is in 
bankruptcy, sections 4022 and 4044(a)(3) of ERISA are to be applied by 
treating the date the sponsor's bankruptcy petition was filed as the 
termination date of the plan. Section 4022 determines which benefits 
are guaranteed by PBGC, and section 4044(a)(3) determines which 
benefits are entitled to priority in ``priority category 3'' in the 
statutory hierarchy for allocating the assets of a terminated plan. 
Thus, under the 2006 amendments, when a plan terminates while the 
sponsor is in bankruptcy, the amount of benefits guaranteed by PBGC and 
the amount of benefits in priority category 3 are fixed at the date of 
the bankruptcy filing rather than at the plan termination date. This 
will, in most cases, reduce the amount of guaranteed benefits and the <script type="text/javascript">

Governors' Designees Receiving Advance Notification of  Transportation of Nuclear Waste]]></title>

</p><p>    On January 6, 1982 (47 FR 596 and 47 FR 600), the U.S. Nuclear 
Regulatory Commission (NRC) published in the Federal Register final 
amendments to 10 CFR Parts 71 and 73 (effective July 6, 1982), that 
require advance notification to Governors or their designees by NRC 
licensees prior to transportation of certain shipments of nuclear waste 
and spent fuel. The advance notification covered in Part 73 is for 
spent nuclear reactor fuel shipments and the notification for Part 71 
is for large quantity shipments of radioactive waste (and of spent 
nuclear reactor fuel not covered under the final amendment to 10 CFR  Part 73).</p><p>    The following list updates the names, addresses, and telephone 
numbers of those individuals in each State who are responsible for 
receiving information on nuclear waste shipments. The list will be 
published annually in the Federal Register on or about June 30, to 
reflect any changes in information. Current State contact information

Department of the Navy NEPA regulation (32 CFR part 775), and the 
Marine Corps Environmental Compliance and Protection Manual, which is 
Marine Corps Order P5090.2A (MCO P5090.2A), the Department of the Navy 
announces its decision to develop the area west of Interstate 95 
(Westside) at Marine Corps Base Quantico (MCB Quantico), Virginia. This 
action will include implementation of the 2005 Base Realignment and 
Closure (BRAC) action at MCB Quantico. The development of Westside and 
implementation of BRAC 2005 at MCB Quantico will be accomplished as set 
out in the Preferred Alternative and described in the Final 
Environmental Impact Statement (Final EIS) of April 2008.

  <title><![CDATA[  Magnuson-Stevens Act Provisions; General Provisions for Domestic  Fisheries; Application for Exempted Fishing Permits]]></title>

  <description><![CDATA[ The Assistant Regional Administrator for Sustainable 
Fisheries, Northeast Region, NMFS has made a preliminary determination 
that the subject exempted fishing permit (EFP) application contains all 
the required information and warrants further consideration. Therefore, 
NMFS announces that the Assistant Regional Administrator proposes to 
recommend that an EFP be issued that would allow one commercial fishing 
vessel to conduct fishing operations that are otherwise restricted by 
the regulations governing the fisheries of the Northeastern United 
States. The EFP, which would enable the applicants to investigate the 
bycatch variability of different groundfish trawl codend configurations 
with a small mesh cover, would allow for exemptions for one vessel from 
the Northeast (NE) Multispecies and Monkfish Fishery Management 
Programs, as follows: NE multispecies Gulf of Maine (GOM) minimum mesh 
size. The EFP would also allow temporary exemptions from the following

  <title><![CDATA[  Fisheries of the Northeastern United States; Atlantic Mackerel,  Squid, and Butterfish Fisheries; Amendment 9]]></title>

  <description><![CDATA[ NMFS is implementing approved measures contained in [[Page 37383]]<br/>
Amendment 9 to the Atlantic Mackerel, Squid, and Butterfish (MSB) 
Fishery Management Plan (FMP). Amendment 9 was developed by the Mid
Atlantic Fishery Management Council (Council) to remedy deficiencies in 
the FMP and to address other issues that have arisen since Amendment 8 
to the FMP became effective in 1999. Amendment 9 establishes multiyear 
specifications for all four species managed under the FMP (mackerel, 
butterfish, Illex squid (Illex), and Loligo squid (Loligo)) for up to 3 
years; extends the moratorium on entry into the Illex fishery, without 
a sunset provision; adopts biological reference points recommended by 
the Stock Assessment Review Committee (SARC) for Loligo; designates 
essential fish habitat (EFH) for Loligo eggs based on best available 
scientific information; and prohibits bottom trawling by MSBpermitted 
vessels in Lydonia and Oceanographer Canyons.

an appealable decision adjusting the entitlement granted to the Native 
village of Chickaloon by Section 12(a) of the Alaska Native Claims 
Settlement Act will be issued to Chickaloon Moose Creek Native 
Association, Inc. The adjustment is made pursuant to Sec. 12(a)(3) of 
the Act of January 2, 1976, and Section 4(a) of the Act of October 4,  1976. The adjusted entitlement is as follows:<br/>

agreement between the Bureau of Industry and Security, United States 
Department of Commerce (``BIS''), and Respondent Omega Engineering, 
Inc. (``Omega''), thenAssistant Secretary for Export Enforcement Julie 
L. Myers issued an order (68 Fed. Reg. 65033, Nov. 18, 2003), resolving 
an administrative proceeding against Omega pursuant to section 13(c) of 
the Export Administration Act of 1979, as amended (``Act''),\1\ and the 
Export Administration Regulations (``Regulations''),\2\ based on 
allegations in a proposed charging letter that Omega had committed 17  violations of the Regulations.<br/>
    \1\ 50 U.S.C. app. 24012420 (2000). Since August 21, 2001, the 
Act has been in lapse and the President, through Executive Order 
13222 of August 17, 2001 (3 CFR 2001 Comp. 783 (2002)), which has

  <description><![CDATA[ The Office for Human Research Protections (OHRP), Office of 
Public Health and Science is seeking information and comments from 
affected entities and individuals about (a) Whether OHRP should issue 
additional guidance recommending that institutions engaged in human 
subjects research conducted or supported by the Department of Health 
and Human Services (HHS) implement training and education programs for 
certain individuals involved in the conduct, review, or oversight of 
human subjects research, or (b) whether HHS should develop a regulation 
requiring the implementation of such training and education programs. 
This request for information and comment stems from the 1998 report 
from the HHS Office of Inspector General (OIG) recommending that 
Federal requirements be enacted to help ensure that investigators and 
institutional review board (IRB) members be adequately educated about, 
and sensitized to, human subjects protections. More recently, the

Grant of Authority for Subzone Status, Louisiana Energy Services,  L.P. (Gas Centrifuge Production Equipment), Lea County, NM</p><p>    Pursuant to its authority under the ForeignTrade Zones Act, of 
June 18, 1934, as amended (19 U.S.C. 81a81u), the ForeignTrade  Zones Board (the Board) adopts the following Order:</p><p>    Whereas, the ForeignTrade Zones Act provides for ''...the 
establishment... of foreigntrade zones in ports of entry of the United 
States, to expedite and encourage foreign commerce, and for other 
purposes,'' and authorizes the ForeignTrade Zones Board to grant to 
qualified corporations the privilege of establishing foreigntrade 
zones in or adjacent to U.S. Customs and Border Protection ports of  entry;</p><p>    Whereas, the Board's regulations (15 CFR Part 400) provide for the 
establishment of specialpurpose subzones when existing zone facilities

Comments will be considered before the FTC submits a request for Office
