to grant to Nomadics, Inc., a revocable, nonassignable, exclusive 
license to practice in the field of use of chemiluminescent detection 
of trace chemical analytes that are potential chemical threats to 
health, welfare, national defense and homeland security, such as 
chemical warfare agents, explosives, and toxic industrial chemicals 
(TIC's) that may be released deliberately or accidentally, using a 
highly sensitive instrument either as a stand alone device or 
integrated into a device that includes other ICx technologies in the 
military, homeland security, first responder, law enforcement, and 
industrial markets in the United States and certain foreign countries, 
the Governmentowned invention described in U.S. Patent No. 6,579,722 
entitled ``Chemiluminescence Chemical Detection of Vapors and Device 
Therefor'', Navy Case No. 76,653 and any continuations, divisionals or 
reissues thereof.

  <title><![CDATA[  Revised Non-Foreign Overseas Per Diem Rates ]]></title>

  <description><![CDATA[ The Per Diem, Travel and Transportation Allowance Committee is 
publishing Civilian Personnel Per Diem Bulletin Number 260. This 
bulletin lists revisions in the per diem rates prescribed for U.S. 
Government employees for official travel in Alaska, Hawaii, Puerto 
Rico, the Northern Mariana Islands and Possessions of the United 
States. AEA changes announced in Bulletin Number 194 remain in effect. 
Bulletin Number 260 is being published in the Federal Register to 
assure that travelers are paid per diem at the most current rates.

  <title><![CDATA[  Record of Decision for the Development of the Westside of Marine  Corps Base Quantico, Including the 2005 Base]]></title>

  <description><![CDATA[ Pursuant to Section 102(2)(c) of the National Environmental 
Policy Act (NEPA) of 1969, 42 U.S.C. Section 4332(2)(c), the 
regulations of the Council on Environmental Quality's (CEQ) for 
Implementing the Procedural Provisions of (40 CFR parts 15001508), the 
Department of the Navy NEPA regulation (32 CFR part 775), and the 
Marine Corps Environmental Compliance and Protection Manual, which is 
Marine Corps Order P5090.2A (MCO P5090.2A), the Department of the Navy 
announces its decision to develop the area west of Interstate 95 
(Westside) at Marine Corps Base Quantico (MCB Quantico), Virginia. This 
action will include implementation of the 2005 Base Realignment and 
Closure (BRAC) action at MCB Quantico. The development of Westside and 
implementation of BRAC 2005 at MCB Quantico will be accomplished as set 
out in the Preferred Alternative and described in the Final 
Environmental Impact Statement (Final EIS) of April 2008.

functions of the FAR, and whether it will have practical utility;

intent to prepare an Environmental Impact Statement for TRIDENT Support 
Facilities Explosives Handling Wharf, Naval Base KitsapBangor, 
Silverdale, Kitsap County, WA, as published in the Federal Register,  June 10, 2008 (73 FR 112).</p><p>    The previously published notice is cancelled because the DON has 
determined that this MILCON project is not ready for consideration in 
the current budget cycle and therefore the project will not be funded. 
DON will perform a thorough Business Case Analysis on this project, a 
thorough review and validation of the project requirement and timeline, 
and will explore and identify other alternative solutions to this $780M 
MILCON project.

  <title><![CDATA[  Intent To Prepare a Draft Environmental Impact Statement for the  Clear Creek General Reevaluation Study, Brazoria,]]></title>

  <description><![CDATA[ The Clear Creek watershed drains portions of Fort Bend, 
Harris, Galveston, and Brazoria counties, Texas, including portions of 
Houston and the smaller towns of League City, Friendswood and Pearland, 
among others. The watershed also forms part of the boundary between 
Harris County to the north and Galveston and Brazoria counties to the 
south. Clear Creek flows into the west side of upper Galveston Bay 
through Clear Lake. The Draft Environmental Impact Statement (DEIS) 
will evaluate several flood detention and conveyance features to reduce 
flooding of homes and businesses in the Clear Creek Watershed. The 
study will focus on environmental and social conditions currently 
present and those likely to be affected by the proposed changes in the 
watershed. The floodcontrol project includes construction of several 
miles of high flow channel adjacent to the existing channel, while 
preserving the existing channel and floodplain forest. Detention of

partial list of military installations closing or realigning pursuant 
to the 2005 Defense Base Closure and Realignment (BRAC) Report. It also 
provides a corresponding listing of the Local Redevelopment Authorities 
(LRAs) recognized by the Secretary of Defense, acting through the 
Department of Defense Office of Economic Adjustment (OEA), as well as 
the points of contact, addresses, and telephone numbers for the LRAs 
for those installations. Representatives of state and local 
governments, homeless providers, and other parties interested in the 
redevelopment of an installation should contact the person or 
organization listed. The following information will also be published 
simultaneously in a newspaper of general circulation in the area of

Army, and other Army initiatives. This includes the stationing of a 
Heavy Brigade Combat Team (HBCT) of approximately 3,800 Soldiers at

development and deployment of new systems in response to rapidly 
changing world conditions and longterm Department of Defense, U.S. 
Army Developmental Test Command, and Army planning. Specifically, this 
EIS will assess environmental impacts associated with changing land 
uses to allow for expanded offroad maneuver in some areas, to support 
new testing capabilities and requirements, and continuing offpost to

  <title><![CDATA[  Feasibility of a Reciprocal Defense Procurement Memorandum of  Understanding With Poland]]></title>

  <description><![CDATA[ DoD is soliciting information from U.S. industry that has had 
experience participating in public defense procurements conducted by or 
on behalf of Poland's Ministry of National Defense or Armed Forces. DoD 
is considering the possibility of negotiating a Reciprocal Defense 
Procurement Memorandum of Understanding (RDP MOU) with Poland. The 
contemplated MOU would involve reciprocal waivers of buynational laws 
by each country. This would mean that Poland would be added to the list 
of ``qualifying countries'' in the Defense Federal Acquisition 
Regulation Supplement (DFARS), and that offers of products of Poland 
would be exempt from the U.S. Buy American Act and Balance of Payments 
Program policy that would otherwise require DoD to add 50 percent to 
the price of the foreign products when evaluating offers. This also 
means that U.S. products should be exempt from any analogous ``Buy 
Polish'' law or policy applicable to Poland's defense procurements. DoD

  <title><![CDATA[  Intent To Prepare a Draft Supplemental Environmental Impact  Statement/Subsequent Environmental Impact Report for the]]></title>

  <description><![CDATA[ In accordance with the National Environmental Policy Act 
(NEPA) and the California Environmental Quality Act (CEQA), the U.S. 
Army Corps of Engineers, San Francisco District, (Corps) in 
coordination with the Port of Sacramento is preparing a draft 
Supplemental Environmental Impact Statement /Subsequent Environmental 
Impact Report (SEIS/SEIR) to evaluate the action of resuming 
construction of navigational improvements to the Sacramento River Deep 
Water Ship Channel (SRDWSC). The SRDWSC runs from the Contra Costa 
county line to the Port of Sacramento. Construction was initiated in 
1989, but work was suspended in 1990 after deepening a portion of the 
channel to the authorized depth of 35 feet. The proposed action 
involves deepening the existing Federal navigation channel from 30 feet 
to 35 feet (mean lower low water) and widening portions of the channel 
to improve navigational efficiency for movement of goods and safety.

establish a restricted area around the AUSTAL, USA shipbuilding 
facility located in Mobile, Alabama, because of the sensitive nature of 
the ongoing and potential future activities at that facility. The 
Supervisor of Shipbuilding, Conversion and Repair (SUPERVISOR), located 
in Bath, Maine is responsible for United States Navy shipbuilding 
activities at AUSTAL, USA located in Mobile, Alabama. The proposed 
restricted area will be used for ongoing construction when vessels are 
placed in the water. The proposed restricted area is essential to 
protect persons and property from the dangers associated with the 
operation and safeguard the area from accidents, sabotage and other 
subversive acts.

the use of Pinecastle Training Range in Florida. The SEIS supplements 
the FEIS for ``Renewal of Authorization to Use Pinecastle Range, Ocala 
National Forest, Florida'' dated January 2002. The Record of Decision 
for the FEIS for ``Renewal of Authorization to Use Pinecastle Range, 
Ocala National Forest, Florida'' was dated March 29, 2002 and published  in the Federal Register on April 10, 2002 (67 FR 17418).</p><p>    Pursuant to 40 CFR 1502.9, a SEIS is being prepared for the limited

Company LLC (a subsidiary of Titan America LLC) to construct the 
Carolinas Cement Company LLC Castle Hayne Project. This project will 
include quarrying to support cement manufacturing in northern New 
Hanover County, NC. The amendment is a change in date and location of 
the scoping meeting and an extension of the comment period deadline. 
The original Notice of Intent was published in the Federal Register on 
May 30, 2008 (73 FR 31072), with a comment deadline of June 30, 2008.

Statement (EIS) to evaluate the potential environmental impacts 
associated with the construction and operation of a proposed new 
Explosives Handling Wharf (EHW) located adjacent to, but separate from, 
the existing EHW on Hood Canal, NBKBangor, WA, to support TRIDENT  submarines.</p><p>    The proposed action consists of inwater and landbased 
construction and infrastructure enhancements including a covered 
ordnance operations area, a support building on the wharf, and a 
warping wharf. As part of the Navy's seabased strategic deterrence 
mission, the Navy Strategic Systems Programs (SSP) directs research, 
development, manufacturing, test, evaluation, and operational support

  <title><![CDATA[  Notice of Intent To Prepare a Draft Environmental Impact  Statement for Carolinas Cement Company LLC Castle Hayne]]></title>

  <description><![CDATA[ The U.S. Army Corps of Engineers (COE), Wilmington District, 
Wilmington Regulatory Division has received a request for Department of 
the Army authorization, pursuant to Section 404 of the Clean Water Act 
and Section 10 of the Rivers and Harbors Act, from Carolinas Cement 
Company LLC (a subsidiary of Titan America LLC) to construct the 
Carolinas Cement Company LLC Castle Hayne Project. This project will 
include quarrying to support cement manufacturing in northern New  Hanover County, NC.</p><p>    The proposed project will require the excavation of an open pit 
adjacent to the Northeast Cape Fear River in order to extract and 
process the raw materials (calcium carbonate and limestone) in order to  produce Portland Cement.</p><p>    Existing infrastructure including railroad, interstate highway, and 
waterways allow for both the shipment of product from the plant and the 
receipt of materials, such as coal. The Castle Hayne site is the 
location of former cement manufacturing facility and an unrelated,

publishing Civilian Personnel Per Diem Bulletin Number 259. This 
bulletin lists revisions in the per diem rates prescribed for U.S. 
Government employees for official travel in Alaska, Hawaii, Puerto 
Rico, the Northern Mariana Islands and Possessions of the United 
States. AEA changes announced in Bulletin Number 194 remain in effect. 
Bulletin Number 259 is being published in the Federal Register to 
assure that travelers are paid per diem at the most current rates.

  <title><![CDATA[  TRICARE; Certain Survivors of Deceased Active Duty Members; and  Adoption Intermediaries]]></title>

  <description><![CDATA[ This rule confirms as final a January 2007 interim final rule 
which implements two provisions of the National Defense Authorization 
Act for Fiscal Year 2006 (NDAA FY06). First, Section 715 of the NDAA 
FY06 extends the time frame certain dependents of active duty service 
members (ADSM) who die while on active duty for more than 30 days shall 
receive TRICARE medical benefits at active duty dependent payment 
rates. Second, Section 592 of the NDAA FY06 modifies the requirement 
for those intermediaries who provide adoption placements. Additionally, 
this final rule makes an administrative clarification to the following 
two eligibility provisions: those placed in the legal custody of a 
member or former member; and those placed in the home of a member or 
former member in anticipation of adoption. This clarification makes a 
distinction between the two groups and specifies that for placement 
into legal custody by court order, the court order must be for a period 
of 12 consecutive months.

  <description><![CDATA[ Under the provisions of the Paperwork Reduction Act of 1995 
(44 U.S.C. Chapter 35), the Federal Acquisition Regulation (FAR) 
Secretariat will be submitting to the Office of Management and Budget 
(OMB) a request to review and approve an extension of a currently 
approved information collection requirement concerning payment by 
electronic fund transfer. This OMB clearance currently expires on  October 31, 2008.</p><p>    Public comments are particularly invited on: Whether this 
collection of information is necessary for the proper performance of 
functions of the FAR, and whether it will have practical utility; 
whether our estimate of the public burden of this collection of 
information is accurate, and based on valid assumptions and 
methodology; ways to enhance the quality, utility, and clarity of the 
information to be collected; and ways in which we can minimize the 
burden of the collection of information on those who are to respond, 
through the use of appropriate technological collection techniques or

  <title><![CDATA[  Certifications and Exemptions Under the International Regulations  for Preventing Collisions at Sea, 1972]]></title>

  <description><![CDATA[ The Department of the Navy is amending its certifications and 
exemptions under the International Regulations for Preventing 
Collisions at Sea, 1972 (72 COLREGS), to reflect that the Deputy 
Assistant Judge Advocate General (Admiralty and Maritime Law) has 
determined that USS STOUT (DDG 55) is a vessel of the Navy which, due 
to its special construction and purpose, cannot fully comply with 
certain provisions of the 72 COLREGS without interfering with its 
special function as a naval ship. The intended effect of this rule is  to warn mariners in waters where 72 COLREGS apply.<br/>

  <title><![CDATA[  Notice of Availability of the Final Environmental Impact  Statement (FEIS) for the Proposed Potash Corporation of]]></title>

  <description><![CDATA[ The U.S. Army Corps of Engineers (COE), Wilmington District, 
Regulatory Division has been reviewing the request for Department of 
the Army authorization, pursuant to Section 404 of the Clean Water Act 
and Section 10 of the Rivers and Harbor Act, from Potash Corporation of 
Saskatchewan Phosphate Division (PCS) for the continuation of its 
phosphate mining operation near Aurora, Beaufort County, NC. PCS 
proposes to undertake an approximately 11,909 acre mine expansion into 
an approximately 15,100 acre project area surrounding its current 
mining operation. This expansion would occur over a 37 year period and 
would impact approximately 4,135 acres of waters of the United States 
including wetlands adjacent to The Pamlico River, South Creek and 
Durham Creek. The Notice of Availability of the Draft Environmental 
Impact Statement (DEIS) for this action was published in the Federal 
Register on Friday, October 20, 2006 (71 FR 61962). The Notice of

  <title><![CDATA[  National Security Personnel System ]]></title>

  <description><![CDATA[ The Department of Defense (DoD) and the Office of Personnel 
Management (OPM) are issuing proposed regulations revising the National 
Security Personnel System (NSPS), a human resources management system 
for DoD, as originally authorized by the National Defense Authorization 
Act for Fiscal Year 2004 and amended by the National Defense 
Authorization Act for Fiscal Year 2008. The proposed regulation governs 
compensation, classification and performance management under NSPS. 
NSPS aligns DoD's human resources management system with the 
Department's critical mission requirements and protects the civil 
service rights of its employees.
