Petition for Declaratory Order for Incentive Rate Treatment approving 
specific incentive rate treatments for PacifiCorp's Energy Gateway  Transmission Expansion Project.</p><p>    Any person desiring to intervene or to protest this filing must  file in accordance with Rules 211 and 214 of<br/> [[Page 41065]]<br/>

  <title><![CDATA[  City and Borough of Sitka; Notice of Preliminary Permit  Application Accepted for Filing and Soliciting Comment,]]></title>

  <description><![CDATA[ July 10, 2008.</p><p>    On June 3, 2008, The City and Borough of Sitka filed an 
application, pursuant to section 4(f) of the Federal Power Act, 
proposing to study the feasibility of the Takatz Lake Project to be 
located on Takatz Lake in the Borough of Sitka, Alaska. The project 
would occupy federal lands managed by the U.S. Forest Service.
</p><p>    The proposed project would consist of: (1) A 200 foot high concrete 
arch dam; (2) a reservoir with an elevation of 1,040 feet mean sea 
level and a capacity of 82,400 acre feet; (3) a 2,800 foot long, 
unlined power tunnel fed by a lake tap and draining into a 1,000 foot 
long steel lined penstock; (4) a powerhouse containing two turbine
generator units with a total installed capacity of 27.7 MW; (5) a 26 
mile long, 69 kv transmission line and; (6) appurtenant facilities. The 
project is estimated to have an annual generation of 106.9 GWh.

  <title><![CDATA[  Pacific Gas and Electric Company; Notice of Preliminary Permit  Application Accepted for Filing and Soliciting]]></title>

  <description><![CDATA[ July 10, 2008.</p><p>    On May 8, 2008, Pacific Gas and Electric Company filed an 
application, pursuant to section 4(f) of the Federal Power Act, 
proposing to study the feasibility of the Mokelumne Pumped Storage 
Project to be located in Amador and Calaveras Counties, California on 
private and federal land managed by the U.S. Forest Service.
</p><p>    The proposed project would consist of one of the following three 
possible designs: (1)(i) Use of the existing Lower Bear River 
Reservoir, with a surface area of 746 acres, storage capacity of 49,079 
acre feet, and normal water surface elevation of 5,822 feet, as the 
upper reservoir with the possibility of a dam raise to increase 
capacity; (ii) a 16,000 foot long power tunnel including intake 
structure, penstock, and tailrace, (2)(i) use of the existing Upper 
Bear River Reservoir, with a surface area of 320 acres, storage 
capacity of 6,756 acre feet, and a normal water surface elevation of 
5,876 feet, as the upper reservoir with the possibility of a dam raise <script type="text/javascript">

located at river mile 220.9 on the Kentucky River at Lock and Dam 12 in 
Estill County, Kentucky. Existing facilities are owned by the Kentucky  River Authority.</p><p>    The proposed project would utilize the existing Lock and Dam 12 
owned by the Kentucky River Authority and would consist of: (1) A 
powerhouse containing 4 turbine generator units producing a total 
installed capacity of 2.7 MW; (2) a 1,000 foot transmission line; and

(2) (i) A dam in the Lower Short Hair Creek area with a height of 175 
ft high and length of 1,700 ft; (ii) a reservoir with full pool

Energy Conservation Program for Certain Industrial Equipment:  Energy Conservation Standards for Commercial Heating,]]></title>

  <description><![CDATA[ The Energy Policy and Conservation Act of 1975 (EPCA), as 
amended, directs the U.S. Department of Energy (DOE) to establish 
energy conservation standards for certain commercial and industrial 
equipment, including commercial heating, airconditioning, and water
heating products. Of particular relevance here, the statute also 
requires that each time the corresponding consensus standardthe 
American Society of Heating, Refrigerating and AirConditioning 
Engineers, Inc. (ASHRAE)/ Illuminating Engineering Society of North 
America (IESNA) Standard 90.1is amended, DOE must assess whether 
there is a need to update the uniform national energy conservation 
standards for the same equipment covered under EPCA. ASHRAE officially 
released an amended version of this industry standard (ASHRAE Standard 
90.12007) on January 10, 2008, thereby triggering DOE's related 
obligations under EPCA. As a first step in meeting these statutory

initiating preparations for the 2009 National Electric Transmission 
Congestion Study pursuant to section 216(a)(1) of the Federal Power Act

hosting six regional technical workshops to receive and discuss input 
concerning electric transmissionlevel congestion. The date for the 
workshop in Atlanta and the starting time of the workshop in Chicago

Power Act, proposing to study the feasibility of the Coffeeville Lock 
and Dam Hydroelectric Project, to be located at the existing U.S. Army 
Corp of Engineers (Corps) Coffeeville Lock and Dam on the Tombigbee  River in Choctaw and Clarke Counties, Alabama.</p><p>    The proposed projects would use the existing Corps Coffeeville Lock

and the Federal Energy Regulatory Commission's regulations, 18 CFR Part 
380 (Order No. 486, 52 FR 47879) the Office of Energy Projects has 
prepared an environmental assessment (EA) for an application filed by 
Central Nebraska Public Power and Irrigation District (licensee) on 
February 12, 2007, requesting Commission approval to amend the Land and 
Shoreline Management Plan (LSMP) for the Kingsley Dam Hydroelectric 
Project (FERC No. 1417). The licensee proposes to reclassify certain 
shoreline lands at Plum Creek reservoir (reservoir) from openspace to 
residential in order to allow adjacent landowners to apply for 
shoreline access facilities. The reservoir is located within the Platte 
River Basin in Dawson and Gosper Counties, near the towns of Lexington 
and Elwood, Nebraska. The project does not occupy any federal lands.

  <title><![CDATA[  Empire Pipeline, Inc. and Empire State Pipeline; Notice of Intent  To Prepare an Environmental Assessment for the]]></title>

  <description><![CDATA[ July 2, 2008.</p><p>    The staff of the Federal Energy Regulatory Commission (FERC or 
Commission) will prepare an environmental assessment (EA) that will 
discuss the environmental impacts of the amended portion of the Empire 
Connector Project involving construction and operation of facilities by 
Empire Pipeline, Inc. (EPI) and Empire State Pipeline (Empire), a 
subsidiary of National Fuel Gas Company, in Ontario County, New 
York.\1\ These amended facilities would consist of about 1 mile of 24
inchdiameter pipeline. This EA will be used by the Commission in its 
decisionmaking process to determine whether the project is in the  public convenience and necessity.<br/>
    \1\ EPI and Empire's application was filed with the Commission 
under section 7 of the Natural Gas Act and Part 157 of the  Commission's regulations.</p><p>    If you are a landowner receiving this notice, you may be contacted

  <description><![CDATA[ July 2, 2008.</p><p>    This constitutes notice, in accordance with 18 CFR 385.2201(b), of 
the receipt of prohibited and exempt offtherecord communications.
</p><p>    Order No. 607 (64 FR 51222, September 22, 1999) requires Commission 
decisional employees, who make or receive a prohibited or exempt off
therecord communication relevant to the merits of a contested 
proceeding, to deliver to the Secretary of the Commission, a copy of 
the communication, if written, or a summary of the substance of any  oral communication.</p><p>    Prohibited communications are included in a public, nondecisional 
file associated with, but not a part of, the decisional record of the 
proceeding. Unless the Commission determines that the prohibited

Energy Conservation Program for Consumer Products: Publication of  the Petition for Waiver of Whirlpool Corporation]]></title>

  <description><![CDATA[ This notice announces receipt of and publishes Whirlpool 
Corporation's (Whirlpool's) Petition for Waiver (hereafter, 
``Petition'') from parts of the Department of Energy (DOE) test 
procedure for determining the energy consumption of electric 
refrigerators and refrigeratorfreezers. The waiver request pertains to 
Whirlpool's specified French door bottommounted residential 
refrigerators and refrigeratorfreezers, a product line that utilizes a 
control logic that changes the wattage of the antisweat heaters based 
upon the ambient relative humidity conditions in order to prevent 
condensation. The existing test procedure does not take humidity or 
adaptive control technology into account. Therefore, Whirlpool has 
suggested an alternate test procedure that takes adaptive control 
technology into account when measuring energy consumption. DOE is 
soliciting comments, data, and information concerning Whirlpool's 
Petition and the suggested alternate test procedure.

  <title><![CDATA[  Preventing Undue Discrimination and Preference in Transmission  Service]]></title>

  <description><![CDATA[ The Federal Energy Regulatory Commission affirms its basic 
determinations in Order Nos. 890 and 890A, granting rehearing and 
clarification regarding certain revisions to its regulations and the 
pro forma openaccess transmission tariff, or OATT, adopted in Order 
Nos. 888 and 889 to ensure that transmission services are provided on a 
basis that is just, reasonable, and not unduly discriminatory. The 
reforms affirmed in this order are designed to: Strengthen the pro 
forma OATT to ensure that it achieves its original purpose of remedying 
undue discrimination; provide greater specificity to reduce 
opportunities for undue discrimination and facilitate the Commission's 
enforcement; and increase transparency in the rules applicable to 
planning and use of the transmission system.

  <title><![CDATA[  Transcontinental Gas Pipe Line Corporation; Notice of Amendment  Application]]></title>

  <description><![CDATA[ July 1, 2008.</p><p>    On June 23, 2008, Transcontinental Gas Pipe Line Corporation 
(Transco), pursuant to section 7(c) of the Natural Gas Act, as amended, 
and section 157 Subpart A of the Federal Energy Regulatory Commission's 
(Commission) regulations, filed to amend its certificate. The requested 
amendment, the Eminence Enhancement Project, would add an additional 
4,735 horsepower compressor unit and appurtenant facilities to provide 
enhanced injection rights to nine customers participating in the 
Eminence salt dome Storage Field in Covington County, Mississippi. The 
Eminence Enhancement Project would cost $19.3 million. So that the 
facilities are available to meet user timing needs, Transco requests

affiliated companies, (collectively, NRG) pursuant to sections 206 and 
306 of the Federal Power Act, 16 U.S.C. 824e and 825e (2000) and Rules 
206 and 306 of the Commission's Rules of Practice and Procedure, 18 CFR 
385.206 and 386.306 (2008), submit this complaint against Entergy 
Services, Inc. (Entergy), alleging that Entergy's May 30, 2008 annual 
transmission rate filing includes bonus compensation paid to Entergy 
employees that should not be passed on to it transmission service  customers.</p><p>    Any person desiring to intervene or to protest this filing must 
file in accordance with Rules 211 and 214 of the Commission's Rules of 
Practice and Procedure (18 CFR 385.211, 385.214). Protests will be
